In order to make the General Terms and Conditions easier to read, no gender-specific formulations (e.g. the course participant) have been used, but women and men are meant equally.
1. VALIDITY
These General Terms and Conditions (GTC) apply as the basis for all contracts for group courses and lessons for individual students and the like held by Dr Stefania Galassi's "Italian Workshop" language school (hereinafter referred to as the "School"). By registering for a course or for lessons in classroom or online mode, at the school or at the student's home, the course participants recognise the GTC and the contract is based on them. The GTC also apply to future or further course registrations without the need for a separate agreement. Agreements that deviate from, supplement or cancel the General Terms and Conditions must be made in writing to be valid.
2. REGISTRATION and PAYMENT
Binding course participation is only possible once the registration form has been received and the entire course fee has been paid.
You can register online, by post or in person at the school. The enrolment form can be downloaded from our website (www.italienisch-werkstatt.de) or collected from the school in person. If the maximum number of course participants set by the institute is exceeded, the date of receipt of the registration together with payment of the full course fee will be used to determine eligibility. The registration is deemed to have been received and legally binding upon receipt by the institute.
According to the service contract, payment of the course fee must be made within 3 days by bank transfer. For registrations made three days or more before the start of the course, the fee must be paid in cash on the first course date or proof of payment must be presented before the course begins. Otherwise the institute reserves the right not to teach the participant. Payment by credit card or debit card is not possible at the school. Invoices will be sent by e-mail on request.
3. COST ASSUMPTION and PROMOTION
If the course participant has a funding commitment from an employer, other persons or other funding bodies, this does not create a contractual relationship between the latter and the school. The course participant's obligation to pay the course fee remains in force until the sponsor has paid the course fee. If the funding is not paid out, the course participant's obligation to pay remains in force.
4. MISSED DATES and CANCELLED LESSONS
For group lessons: Appointments that are not attended cannot be refunded or credited. It is not possible to cancel individual appointments for group lessons. An exchange with private lessons is excluded. There is no entitlement to change to another course once it has started. However, in an emergency, the school will endeavour to find an alternative course for the student, if feasible and as a gesture of goodwill.
The school reserves the right to cancel or postpone an agreed date in the event that the teacher is suddenly unavailable and no substitute teacher can be found. The student or course participant has no right to demand that lessons be held by a particular teacher.
For private lessons: Cancellations must be communicated at least 48 hours before the appointment. Otherwise the cancelled lessons will be charged. If an appointment is cancelled in good time, an alternative date must be arranged by the student in consultation with the instructor. The scheduled dates must be held no later than two weeks after the scheduled end of the course. Lessons not taken by this time will be cancelled without substitution. Holiday periods of the lecturer are not taken into account.
Longer periods of absence of students must be agreed, if possible, when the contract is concluded or at least two weeks in advance.
If lessons are cancelled by the lecturer, new alternative dates will be arranged by arrangement or the fee will be refunded pro rata.
5. TEACHING UNIT
A teaching unit (TU) comprises 45 minutes. The duration of a course appointment for standard courses and individual lessons is two lessons of 45 minutes each, unless otherwise specified. For Plus courses, the duration is 3 lessons of 45 minutes each.
Online courses for individual students and groups can also be offered as 60-minute lessons.
6. MINIMUM NUMBER OF PARTICIPANTS
The school reserves the right to cancel or postpone group courses until the start of the course at the latest if the minimum number of 5 participants is not reached. In this case, there is no entitlement to cancellation of the course.
Course participants have the right - by mutual agreement - to secure the course by paying an additional fee or adjusting the scope of the course accordingly.
If the course is cancelled by the school, the student will receive a full refund of the fee already paid.
7. DISTANCE LEARNING
Students who register for online courses (in live format) accept the ZOOM video platform selected by the school and confirm their acceptance of the Zoom terms of use (https://zoom.us/de-de/terms.html). Students also confirm that they consent to the use of their e-mail address and other data collected by the staff and teachers of the Italian language workshop, as well as by Zoom, for the organisation of these online courses. The Italian language workshop accepts no liability for any consequences caused to participants by the use of the program The student agrees to receive an invitation from the teacher by e-mail before each lesson with a link required to access the virtual "classroom".
The programme must be downloaded free of charge from the Internet by the student. The student undertakes to have the following technical requirements: Laptop or PC, sufficient internet access, microphone and camera.
8. CANCELLATION
Cancellation of a course registration by the applicant is possible up to two weeks before the start of the course at the latest, subject to a cancellation fee of 50%. Cancellation must be made in writing by registered letter or e-mail.
In the event of cancellation within two weeks before the start of the course, the participant will receive a voucher that can be used to attend another course at our school. The voucher is transferable and valid for 12 months.
9. LIABILITY
By registering, the course participant recognises the following: Participation in all seminars is at the participant's own risk and responsibility. The premises are not barrier-free.
The school accepts no liability for any damage, in particular injuries. Course participants are not covered by accident or health insurance through the school.
No liability is accepted for participants' personal belongings.
10. DATA PROCESSING
The disclosure of data in the course of registration takes place with the consent of the applicant. We only collect and store your personal data for organisational reasons. Your data will not be passed on to third parties and will only be passed on if you have given us your written consent to do so.
For private lessons: In order to quickly communicate unexpected, last-minute schedule changes, you agree that your telephone number may be passed on to the respective teachers.
For Online Courses: You agree that your e-mail address may be passed on to the lecturer to enable him to send the Zoom invitation.
Please let us know if your personal details (name, address, telephone number, e-mail address, etc.) change so that we can update them.
11. REHEARSAL HOUR
By prior arrangement with the school, anyone interested can take part in a one-off trial lesson in a course (maximum 2 lessons, 45 minutes each). Before attending the trial lesson, the registration form must be completed with the note "Trial lesson". The school charges a fee for a trial lesson according to the current price list on the website.
12. SEVERABILITY CLAUSE
Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, this shall not affect the validity of the remainder of the contract. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come as close as possible to the economic objective pursued by the contracting parties with the invalid or unenforceable provision.
The contract language is German. German law shall apply.
The place of fulfilment for the school's services is Berlin. The place of jurisdiction is Berlin.
The General Terms and Conditions are available on our website in German. In the case of later versions in other languages, only the German version of the General Terms and Conditions is legally binding.
